Terms of Use

  • You own your data and can export it at any time
  • Cancel any time; annual plans refund pro rata in 30 days
  • 30 days notice before any change to price or terms
  • Liability is capped at the last 12 months of fees

Acceptance of Terms

By accessing or using FuneralHQ (the "Service", "Platform", or "Software") you agree to be bound by these Terms of Use. If you do not agree to these Terms, you may not access or use the Service.

Agreement to terms

  • These Terms constitute a legally binding agreement between you and FuneralHQ.
  • You must be at least 18 years old and have the legal authority to enter into this agreement.
  • If you are using the Service on behalf of a business, you represent that you have authority to bind that entity.
  • We may update these Terms, and continued use after they take effect constitutes acceptance.

Notification of changes

We will notify you of material changes to these Terms by email or through the Service. Changes become effective 30 days after notification, unless otherwise specified.

Service Description

Core features

  • Case management: digital tracking of funeral services from first call to completion
  • Customer relationships: contact management and family communication tools
  • Financial management: billing, invoicing, and payment processing
  • Document management: secure storage and generation of legal documents
  • Reporting and analytics: business intelligence and operational insights

  • Payment processing: Stripe, PayPal
  • Communication tools: email, SMS, and calendar synchronization
  • Third-party APIs: funeral industry integrations

Service availability

We aim to maintain 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance is announced in advance where possible.

Account Registration and Security

Account requirements

  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • One person may not maintain multiple accounts without our written consent.

Account security

  • Strong passwords: use complex passwords and enable two-factor authentication
  • Access control: limit account access to authorized personnel only
  • Current details: keep your contact information and business details up to date
  • Suspicious activity: report any unauthorized access immediately

Business verification

We may require verification of your funeral home license and business credentials before providing full access to certain features.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. Violation of this policy may result in immediate account suspension.

Permitted uses

  • Managing funeral home operations and client relationships
  • Storing and processing data related to funeral services
  • Communicating with families and business partners
  • Generating reports and business analytics

Prohibited activities

  • Illegal activities: using the Service for any unlawful purpose
  • Data misuse: sharing sensitive client information inappropriately
  • System abuse: attempting to hack, disrupt, or overload our systems
  • Spam or harassment: sending unsolicited communications through the platform
  • Intellectual property violation: infringing on others' copyrights or trademarks
  • Reverse engineering: attempting to copy or recreate our software

Compliance requirements

You must comply with all applicable laws and regulations, including:

  • Federal and state funeral industry regulations
  • HIPAA and other privacy laws
  • FTC Funeral Rule compliance
  • State licensing requirements

Payment Terms and Billing

Subscription plans

  • Monthly and annual plans: tiers based on features
  • Custom enterprise: tailored arrangements for larger organizations
  • Payment terms: due upon invoice date

Billing and payment

  • Payment methods: ACH, check, or invoice billing for enterprise customers
  • Billing cycle: monthly or annual
  • Auto-renewal: subscriptions renew automatically unless cancelled
  • Price changes: 30 days notice for any change in pricing

Refund policy

  • Annual subscriptions: pro-rated refunds within the first 30 days
  • Monthly subscriptions: no refunds, but you may cancel at any time
  • Custom development work is non-refundable. Standard plans carry no setup fee.
  • Refunds are processed within 10 business days of approval

Late payment and suspension

Accounts with overdue payments may be suspended after 7 days past due. A $25 late fee may be applied to overdue accounts.

Mobile Messaging Terms

FuneralHQ Family Messaging lets a participating funeral home exchange service and customer-care text messages with a family from the funeral home's business number. The funeral home is identified in the first message or message signature. Message frequency varies with the family's arrangements and requests.

  • Consent: a funeral home may text only a person who provided the number and agreed to receive messages, or who initiated the conversation. Consent to text is not a condition of purchasing goods or services.
  • Opt out: reply STOP to end messages from that number. A confirmation may be sent, after which no further text messages will be sent unless the recipient later replies START or otherwise renews consent.
  • Help: reply HELP for assistance, or contact the funeral home using the contact information it provided. FuneralHQ support is available at raja@funeralhq.com.
  • Charges: message and data rates may apply under the recipient's mobile plan. Carriers are not liable for delayed or undelivered messages.
  • Attachments: photos, PDFs, audio, or video may be sent when supported by the recipient's device and carrier. Do not send information that is unrelated to the funeral home's services.
  • Records: messages, attachments, consent events, and delivery status may be retained with the funeral home's case record as described in our Privacy Policy.

Funeral homes using the Service must maintain accurate consent records, honor opt-out requests, identify themselves clearly, and may not use family messaging for purchased lists, unsolicited promotions, or any prohibited or deceptive content.

Data Ownership and Privacy

Your data rights

  • Ownership: you retain ownership of all data you put into the system
  • Portability: you can export your data at any time
  • Deletion: you can request deletion of your data on account termination
  • Access control: you control who has access to your data within your organization

Our responsibilities

  • Security: data is encrypted in transit (TLS 1.3) and at rest (AES-256)
  • Confidentiality: we will not access your data except as necessary to provide the Service
  • Compliance: we maintain SOC 2 Type II compliance and follow GDPR guidelines
  • Backup: we maintain secure backups of your data

Data processing

We may process your data to provide the Service, improve the platform, and comply with legal obligations. Our Privacy Policy sets out the detail.

Intellectual Property Rights

Our intellectual property

  • Software: the FuneralHQ platform, code, and algorithms
  • Trademarks: the FuneralHQ name, logo, and branding
  • Content: documentation, training materials, and user interfaces
  • Trade secrets: proprietary methods and business processes

License grant

We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription period, subject to these Terms.

Your content

You retain all rights to content you create or upload to the Service. You grant us a license to host, store, and process that content solely to provide the Service.

Feedback and suggestions

Any feedback or suggestions you provide about the Service may be used by us without compensation or attribution.

Account Termination

Termination by you

  • You may cancel your subscription at any time through your account settings.
  • Cancellation takes effect at the end of your current billing period.
  • You remain responsible for charges incurred before cancellation.
  • You may request a data export before your account is closed.

Termination by us

We may terminate your account if:

  • You violate these Terms of Use
  • Your account becomes delinquent on payment
  • You engage in fraudulent or illegal activities
  • We discontinue the Service, with 90 days notice

Effect of termination

  • Your access to the Service is suspended immediately.
  • Your data is retained for 90 days to allow for export.
  • After 90 days, your data is permanently deleted.
  • These Terms continue to apply to any outstanding obligations.

Limitation of Liability and Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data.

Service disclaimers

  • Availability: we do not guarantee uninterrupted service availability
  • Data loss: we maintain backups, and you should maintain your own as well
  • Third-party services: we are not responsible for third-party integrations
  • Compliance: you are responsible for ensuring your use complies with applicable law

Limitation of damages

Our total liability to you for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Service or your violation of these Terms.

General Provisions

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Dispute resolution

Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and FuneralHQ.
