Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

3. Account Registration and Security

Account Requirements

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person may not maintain multiple accounts without our written consent

Account Security

• Strong Passwords: Use complex passwords and enable two-factor authentication
• Access Control: Limit account access to authorized personnel only
• Regular Updates: Keep your contact information and business details current
• Suspicious Activity: Report any unauthorized access immediately

Business Verification

We may require verification of your funeral home license and business credentials before providing full access to certain features.

5. Payment Terms and Billing

• Payment Terms: Due upon invoice date

Billing and Payment

• Payment Methods: ACH, check, or invoice billing for enterprise customers
• Billing Cycle: Monthly or annual billing options available
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Price Changes: 30-day notice for any pricing changes

Refund Policy

• Annual subscriptions: Pro-rated refunds within first 30 days
• Monthly subscriptions: No refunds, but you can cancel at any time
• Setup fees and custom development work are non-refundable
• Refunds processed within 10 business days of approval

Late Payment and Suspension

Accounts with overdue payments may be suspended after 7 days past due. A $25 late fee may be applied to overdue accounts.

License Grant

We grant you a limited, non-exclusive, non-transferable license to use our Service during your subscription period, subject to these Terms.

Feedback and Suggestions

Any feedback or suggestions you provide about our Service may be used by us without compensation or attribution.

8. Account Termination

Termination by You

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You remain responsible for charges incurred before cancellation
• You may request data export before your account is closed

Termination by Us

We may terminate your account if:

• You violate these Terms of Use
• Your account becomes delinquent on payment
• You engage in fraudulent or illegal activities
• We discontinue the Service (with 90 days notice)

Effect of Termination

• Your access to the Service will be immediately suspended
• Your data will be retained for 90 days to allow for data export
• After 90 days, your data will be permanently deleted
• These Terms will continue to apply to any outstanding obligations

9. Limitation of Liability and Disclaimers

Service Disclaimers

• Availability: We do not guarantee uninterrupted service availability
• Data Loss: While we maintain backups, you should maintain your own data backups
• Third-Party Services: We are not responsible for third-party integrations or services
• Compliance: You are responsible for ensuring your use complies with applicable laws

Limitation of Damages

Our total liability to you for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Service or violation of these Terms.

10. General Provisions

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Dispute Resolution
